Loss of farm land and commodities from that farming(Item#8). <br /> The Applicant must comply with the requirements of the Act and Rules and all applicable <br /> performance standards if the permit application is approved by the Board. The Applicant is <br /> obligated to protect areas outside the affected land from slides and damage pursuant to Rule <br /> 3.1.5(3) and C.R.S. § 34-32.5-116(4)(i) and to prevent disturbances to the prevailing hydrologic <br /> balance of the affected land and of the surrounding area and to the quantity or quality of water in <br /> surface and groundwater systems both during and after the mining operation and during <br /> reclamation pursuant to Rule 3.1.6(1) and C.R.S. §34-32.5-116(4)(h). <br /> Zoning determinations and changes are under the jurisdiction of Weld County and the Town of <br /> Gilcrest. These issues should be addressed through the permitting processes of Weld County and <br /> the Town of Gilcrest. <br /> Conclusion <br /> After conducting a thorough technical review of the application, as outlined in part in the discussion <br /> above, on February 9, 2023,the Division determined the application satisfied the requirements of <br /> the Act and Rules, and specifically C.R.S. § 34-32.5-115(4),and issued its recommendation to <br /> approve the Construction Materials 112 application for the Section 20 Gravel Mine, File No. M- <br /> 2022-001. <br />
