BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE NOTICE OF OURAY SILVER MINES OF A <br /> FIRST PERIOD OF TEMPORARY CESSATION, File No. M-2012-032 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") as a <br /> consent item on November 16, 2022, via videoconference to consider the notice of a <br /> first period of temporary cessation filed by Ouray Silver Mines ("Operator"), file <br /> number M-2006-017 ("permit"). <br /> The Board, having considered the materials presented with this consent <br /> agenda item and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(d) reclamation permit for an underground silver <br /> operation. The site is known as the Revenue Mine and is located in Ouray County, <br /> Township 43 North, Range 8 West, Section 21, loth Principal Meridian. <br /> 2. The Notice stated that temporary cessation began on August 16, 2022. <br /> 3. Operator has committed to comply with the reclamation requirements <br /> related to Rule 3.1 of the Mineral Rules and Regulations for Hard Rock, Metal, and <br /> Designated Mining Operations (the "Rules"). <br /> 4. The financial warranty is adequate to cover current reclamation. <br /> 5. The Division has identified no performance standard issues in the <br /> notice or through an inspection of the file for the site. <br /> 6. Division provided notice to all interested parties of Operator's notice, <br /> and no interested parties objected to or expressed concerns with the notice. <br /> CONCLUSIONS OF LAW <br /> 7. The Board has jurisdiction over this matter pursuant to the Mined <br /> Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br />
