BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE RECONSIDERATION OF APPROVAL OF 110c <br /> PERMIT AND REQUEST OF WEIMER RANCHES, LLLP TO EXTEND THE <br /> SUBMISSION DEADLINE FOR FINANCIAL WARRANTY, File No. M-2021- <br /> 045 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> November 4, 2022 as a consent item to reconsider the previous approval of the <br /> application of Weimer Ranches, LLLP ("Applicant")for a 110c permit, file number <br /> M-2021-045, and Applicant's request to extend the deadline for submission of <br /> financial warranty. <br /> The Board, having considered the materials submitted, and being otherwise <br /> fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division for a I10c reclamation <br /> permit for a 10-acre sand and gravel site known as the Weimer Ranches#4 Mine in <br /> Montrose County, Colorado (the "Application"), located in Section 13, Township 46 <br /> North, Range 16 West, 6th Principal Meridian. <br /> 2. There were no objections to the Application filed with the Division, and <br /> the Division approved the Application on August 27, 2021. <br /> 3. The Division set the financial warranty for the site at $33,105. <br /> 4. Under Rule 4.1(2)of the Mineral Rules and Regulations of the <br /> Colorado Mined Land Reclamation Board for the Extraction of Construction <br /> Materials (the"Rules"),Applicant had one calendar year from the approval of the <br /> Application to submit the financial warranty or the Board would reconsider the <br /> previous approval of the Application. <br /> 5. In a letter received by the Division on September 13, 2022, Applicant <br /> requested an extension of six months to submit the required financial warranty. <br /> 6. Applicant provided proof that it had complied with all public notice <br /> requirements of Rule 1.6. <br /> 7. The Division did not receive any objections in response to the public <br /> notices Applicant provided in accordance with Rule 1.6. <br />
