4. Operator failed to submit the permit conversion application within the <br /> deadline set by the October 22, 2021 Order. <br /> 5. On February 1, 2022, the Division inspected the site. Ms. Goldberg <br /> (also known as Ms. Branch) attended the inspection. During the inspection, the <br /> Division discussed what needed to be done to comply with the Board's Order with <br /> Ms. Goldberg and subsequently sent her a list of consultants who had previously <br /> assisted in permit applications before the Division. <br /> 6. On February 23, 2022, the Division mailed a Reason to Believe a <br /> Violation Exists Letter to Operator, providing notice of an alleged violation for <br /> failure to comply with the Board's October 22, 2021 Order and providing notice the <br /> matter would be heard at the Board's April 20, 2022 meeting. <br /> 7. At the April 20, 2022 Board meeting, the hearing was continued to the <br /> Board's July 2022 meeting to give Operator more time to comply with October 22, <br /> 2021 Order. <br /> S. Through a Reason to Believe a Violation Exists letter dated June 23, <br /> 2022, the Division informed Operator that due to a scheduling conflict, the hearing <br /> was again continued to the Board's August 2022 meeting. <br /> 9. On August 11, 2022, the Division was informed that there was a <br /> dispute as to who had legal right to represent Operator. <br /> 10. Through a letter dated August 22, 2022, the Division requested <br /> documentation from Ms. Goldberg as to who was legally entitled to represent <br /> Operator and informed Operator that the hearing was rescheduled to the Board's <br /> September 2022 meeting. <br /> 11. Ms. Goldberg subsequently provided the Division documentation that <br /> she was legally entitled to represent Operator. <br /> 12. In a letter dated October 4, 2022, the Division provided Operator <br /> notice that the hearing had been continued to the Board's December 14, 2022 <br /> meeting to give Operator more time to comply with the October 22, 2021 Order's <br /> corrective actions. <br /> 13. At the December 14, 2022 hearing, the Division presented testimony <br /> regarding the chronology of the matter, describing the Division's efforts to contact <br /> Operator, issues with disputes over who could represent the Operator, and the fact <br /> that Operator had not yet submitted a permit conversion application to comply with <br /> the corrective actions required by the October 22, 2021 Order. <br /> HCR High Country Repair, <br /> Ghost River Gravel Pit/M-2003-002 <br /> 2 <br />
