i <br /> Summary, Conclusions,and Recommendations <br /> Portions of the Sherman Mine are situated on unpatented lode mining claims and mill <br /> sites located on public lands managed by the Bureau of Land Management(BLM). <br /> The Sherman Mine was developed in the 1970's and closed in 1985 with no production <br /> of any ore material after that time. The buildings and mine have been deteriorating since <br /> the closure in 1985. Today the site is experiencing severe erosion and the buildings have <br /> become a safety and environmental hazard. All of the equipment has been removed, <br /> vandalized,or is completely deteriorated. <br /> The Captain Fremont and McHigh unpatented lode mining claims,and the Sherman mill <br /> sites Nos. 1-3 are not being occupied for uses that are reasonably incident to,or necessary <br /> for,prospecting,mining,or processing operations under the mining laws as provided for <br /> by 43 CFR 3712.1 and Section 4(a)of the Act of July 23, 1955. The Captain Fremont <br /> and McHigh lode mining claims,and the Sherman mill sites Nos. 1-3 are not being <br /> occupied in good faith for purposes of prospecting,mining,or processing operations <br /> under the mining laws. <br /> The findings of this report are: <br /> • The activities on this site*.not fall within the definition of substantially regular <br /> work. <br /> • The buildings,equipment,and mine pad are not used and occupied for a mining <br /> operation. <br /> • The condition of mine,equipment,and waste piles on unpatented mining claims <br /> constitutes unnecessary and undue degradation of the public lands. <br /> The recommendations of this report are to pursue final reclamation of the site including <br /> the removal of all structures,equipment,and debris,currently on site. In addition, <br /> measures need to be taken to ensure that the significant erosion hazards on site are <br /> minimized. <br /> 3 <br />
