The MLRB ordered Leadville Corporation to post a new bond in <br /> the amount of$765,443.00 within sixty(60)days ofthe signature date of the order,or,in the alternative, <br /> to complete reclamation within sixty(60)days,such that the current amount of$91,600.00 would be <br /> adequate to complete reclamation. The Board Order was signed on August 12,2005. Therefore the <br /> deadline for corrective action was October 11,2005. <br /> Leadville Corporation has not completed the corrective actions for the Sherman Mine and Mill permit, <br /> as confirmed via an inspection of the site. Therefore, the Division believes the Operator to be in <br /> possible violation ofthe Colorado Mined Land Reclamation Act and the Hard Rock/Metal Mining Rules <br /> and Regulations,specifically C.R.S.34-32-124 for failure to comply with the conditions of an order. <br /> A Formal Public Hearing will be held during the November 16th and 17th Board meeting for consideration of <br /> a possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br /> beginning at 10:00 am.on November 16th,and at 9:00 a.m. on November 17th or as soon thereafter as the <br /> matter can be considered. At that hearing you will have the opportunity to be represented and heard. It will <br /> be reiterated that there is reason to believe that you are in violation of the provisions noted above. <br /> If the Board finds a violation at this hearing,it may order the permit be suspended,modified,or revoked and <br /> may order the bond forfeited under C.R.S.34-32-124(6)(a),and may issue civil penalties under C.R.S.34-32- <br /> 124(7). If you have evidence indicating that the possible violations noted above do not exist or have been <br /> corrected,please provide it to the Division as soon as possible or bring it to the hearing. <br /> Following the hearing, all parties will have an opportunity to review and comment on a draft of the <br /> Board's order before it is issued. If you wish to do so,you must provide the Board a written request to <br /> review the draft order prior to or during your hearing.
