structure is not a part of the New Horizon reclamation plan, nor is it the responsibility of ERMR. <br /> The area of concern is not a part of this bond release application, and it is no longer within the <br /> permit area. Mr. Richards also noted concerns with a 12" diameter irrigation pipeline. <br /> Although, this property had previously been approved as dryland pasture post-mining land use, <br /> Mr. Richards voiced concern that irrigated pasture was not returned. This property was approved <br /> for final bond release with SL22, approved March 12, 2020, and removed from the permit area <br /> with the approval of TR98, June 4, 2020. No objections were received from Mr. Richards during <br /> SL22 or TR98. <br /> Mrs. Elma Burbridge was notified of the scheduled bond release inspection via certified mail. <br /> The Burbridges opted not to attend the inspection and did not send a representative in their place. <br /> The Burbridges did not express any written concerns or objections with the bond release <br /> application. <br /> II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br /> PHASE I <br /> Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br /> permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br /> approved reclamation plan." <br /> With regard to Phase I bond release, the approved reclamation plan for the New Horizon Mine calls for <br /> sealing each of the monitoring and backfill wells in accordance with Rule 4.07.3. After well <br /> abandonment,the ground surface is graded to blend with the surrounding area. <br /> In addition to the reclaimed monitoring wells, 24.5 acres are requested for Phase I bond release. Three <br /> parcels are included in the Phase I bond release request; <br /> The first parcel includes SP-2 stock pond and surrounding area consisting of 1.9 acres. SP-2 is located <br /> in the location of the reclaimed sediment Pond 9. In 2020, the operator reconfigured pond 9 to <br /> permanent stock pond SP-2. The permanent stock pond and reconfiguration was approved with TR93 <br /> (December 2, 2019). SP-2 is functioning well, the vegetation is establishing, and no concerns were <br /> identified with the permanent stock pond or the reclaimed area around it. <br /> The second parcel requested for Phase I bond release consists of 19.9 acres on the west half of the <br /> southeast quarter of Section 36. This parcel is immediately west of reclamation parcel IP-11, and will be <br /> reclaimed to a post-mining land use of Irrigated Pasture. <br /> The third parcel requested for Phase I bond release consists of 2.7 acres of the reclaimed topsoil <br /> stockpile E footprint. All of topsoil stockpile E has been used or relocated during reclamation activities. <br /> The stockpile footprint was regraded in 2020. The topsoil stockpile footprint is located at the southern <br /> end of the permit area in the southeast quarter of Section 6, and immediately east of sediment pond 18. <br /> The post mining land use on this parcel is Dryland Pasture. <br /> C1981008 SL25 Page 6 of 14 <br />
