Below are the comments and the corresponding responses that we
have provided to address the adequacy review comments.
1. Exhibit E needs to be updated to describe the new reclamation plan.
Response: The updated Exhibit E is attached with descriptions of the new
reclamation plan.
2. On the Reclamation Plan Map (Exhibit F), please indicate the status and plan for the blank
area in the northwest corner. Is this area undisturbed by mining activity? Or will this area be
hard surface?
Response: The area is undisturbed by mining so no reclamation is needed at the
location. This is the area of the existing ditch that runs from the north side of the
property to the west side and then south before exiting the property.
3. On Exhibit F, indicate what work is complete and what work will be completed in the future.
This can be done using notes or a text box.
Response: All work has been completed for the mine reclamation. The updated
Exhibit F map is attached with notes and changes for Item number 4, as well.
4. Regarding the notes on Exhibit F, please explain if the verb tense is accurate. For example,
they state that soils "will be" placed and fill "will be" compacted. As appropriate, revise the
text in the notes to state what has already been completed.
Response: The updated Exhibit F is attached with the updated text stating that the
tasks are completed.
5. Exhibit L must be updated to show the remaining reclamation tasks. If all work has been
completed, state that in the text. A task for maintenance of the site, including repair of rills
on the slopes, should be included.
Response: All work has been completed. The next step will be submitting a release of
the current financial warranty of$244,389.00. The Ogilvy Irrigating and Land Company
owns the reclaimed water storage reservoir and will maintain the site including the
V M 305 Denver Avenue—Suite D• Fort Lupton CO 80621 • Ph: 303-857-6222
