Syracuse Way, Suite 450 <br /> Greenwood Village, CO 80111 <br /> Re: NOTICE OF CONTINUANCE; <br /> Mid-Continent LST; Permit No.M-1982-121 <br /> Mr. Wagner: <br /> On January 25, 2023, the Division of Reclamation, Mining and Safety (Division) mailed a Reason to <br /> Believe (RTB) a violation exists regarding your 112c Construction Materials Permit, No. M-1982-121. <br /> This matter was scheduled to appear before the Mined Land Reclamation Board during the March 22-23, <br /> 2023 hearing. Due to weather and safety concerns for onsite personal conducting the site investigation, <br /> the Operator has requested a continuance. This notice is to inform you that the Division agrees with the <br /> request and this matter is being continued. A Formal Public hearing will be held during the April 19-20, <br /> 2023 Board Meeting for consideration of the possible violation(s). Please be advised that some of the <br /> meeting deadlines have also changed, detailed below. <br /> The hearing will be held in Room 318 of 1313 Sherman Street,Denver, Colorado, beginning at 9:00 a.m. <br /> on April 19, 2023 or as soon thereafter as the matter can be considered. At that hearing you will have the <br /> opportunity to present your defense. <br /> In order to be considered at the hearing, all exhibits,materials and witness testimony you wish for the <br /> Board to consider must be submitted by 5:00 PM on April 7, 2023 via email to the Board Administrator. <br /> You must also provide a list of all witnesses,if any, to the Board Administrator, Camille M. Mojar at: <br /> dnr_dims_mlrb-submittals(c�r�,state.coms,no later than 5:00 PM, April 7, 2023. <br /> If you have good cause not to appear in person you must submit a request to the Board to appear virtually <br /> (via ZOOM). To do so,please submit an email to the Board Administrator, no later than 5:00 PM on April <br /> 7, 2023 for Board consideration. If approved you will receive an authorization code to attend the meeting <br /> for this matter. Please note that only Parties and those who will be testifying may participate in the <br /> hearing.
