When reviewing proposed page ii of Tab 20— Table of Contents, it appears Exhibit 20-3 is <br /> incorrectly labeled as Exhibit 20-2. Please provide and updated page ii of Tab 20 —Table of <br /> Contents with the corrected reference to Exhibit 20-3. <br /> a. Page ii of the TOC for Tab 20 has been updated and submitted with this response. <br /> 2. When reviewing proposed page 1 of Tab 20, the text refers to the `proposed' post-miming land <br /> uses that are being updated under TR-12. While the Division understands that these changes to <br /> the post- mining land use are currently being proposed during the review process, with the <br /> Issuance of the TR- 12, these changes will be approved and will no longer `proposed'. The text <br /> under TR-12 should reflect the intent of what will be approved. Please provide an updated page <br /> 1 of Tab 20 removing references to the `proposed' post-mining land use. <br /> a. Page 1 of Tab 20 has been revised to remove "proposed" from the language. The new <br /> page has been submitted with this submittal. <br /> 3. Per Rule 2.05.5(1)(b), post-mining land use description shall be accompanied by a copy of the <br /> comments concerning the proposed use by the legal or equitable owner of record of the surface <br /> of the proposed permit area and the State and local government agencies which would have to <br /> initiate, implement, approve, or authorize the proposed use of the land following reclamation. <br /> When reviewing TR-12, comments have not been provided from all the landowners of record <br /> in which the Tie Across Haul Road exists within their property boundary. The following list is <br /> taken from the from the approved Exhibit 3-1 which shows all landowners that potentially <br /> overlap with the Tie Across Haul Road: <br /> • Public Service of Colorado • Area 51 Farms, LLC <br /> • Sage Creek Holdings, LLC 9 State of Colorado <br />
