Applicant wishes to maintain lining of the reservoirs as an option only, then the <br /> Application must be revised to reflect that the reservoirs will be reclaimed to open <br /> groundwater ponds. If the Applicant chooses to reclaim the reservoirs to open <br /> groundwater ponds, then the following options are available to address the liability <br /> associated with exposed groundwater: <br /> Raptor Materials First Adequacy Response <br /> Please consider the Application Form to be correct and disregard any ambiguity in <br /> the application exhibits. Raptor Materials intends to establish lined reservoirs in <br /> final reclamation for the purpose of establishing a Developed Water Resource. <br /> a) Provide adequate bond to backfill the pit to two feet above the historic highest <br /> groundwater level. <br /> Raptor Materials First Adequacy Response <br /> The application is clarified to reflect choice of lined reservoirs for final reclamation <br /> eliminating the need for backfill calculations. <br /> b) Obtain a court approved augmentation plan prior to exposing groundwater at the <br /> site. <br /> Raptor Materials First Adequacy Response <br /> As the pits will be open ponds until they are lined and approved by the Office of the <br /> State Engineer, a court approved substitute water supply plan will be obtained prior <br /> to exposing groundwater at the site.
