Pyrite, which has approximately half the heating <br /> value of coal, can be used as an alternative energy fuel, is used in lithium metal batteries, and has <br /> been proposed as a low-cost material for photovoltaic solar panels. There are also markets for <br /> pyrite as a metallurgical flux and for sintering in smelters, roasting ore from other mines. <br /> 17. RFES reclaims other metals through various hydro-metallurgical refining processes <br /> via precipitation or electrolytic refining. RFES sells these important metals and associated salts to <br /> numerous industries. <br /> 18. Throughout RFES' entire process, all tailings are treated to ensure full use. There <br /> is zero waste discharge and no resulting hazardous waste. Everything gets used and/or sold into <br /> industry. <br /> 19. In addition to processing historic mine waste, RFES also refines and recycles a <br /> broad range of industrial and consumer goods, everything from e-waste to plated base metals. <br /> 20. RFES conducts all its processing operations — including reclamation of mining <br /> waste and other commercial recycling enterprises—at a facility RFES owns at 17200 Highway 72 <br /> in unincorporated Jefferson County, Colorado, approximately 2.4 miles east of State Highway 93 <br /> at the end of Umber Court (the "Facility"). The Facility is located on an approximately 1.9 acre <br /> parcel. RFES purchased the parcel and facility in 2020. <br /> 21. Third parties deliver all the materials that RFES processes to RFES' Facility. No <br /> extractive or surface disturbing activities occur on RFES' property. <br /> 22. RFES' Facility is located on a former Superfund site,previously used as a chemical <br /> factory. The Facility includes a large warehouse, several water tanks, designated spill containment <br /> areas, and numerous concrete bins and holding areas. All RFES' operations are conducted either <br /> indoors or on concrete pads located within the Facility. <br /> 23. The land on which RFES' Facility is located is zoned as Industrial-Two ("1-2"). <br /> Uses permitted within an I-2 zone include,but are not limited to: (i)chemicals,heavy or industrial; <br /> (ii)coal and coke;(iii)metals,extraction or smelting; (iv)casting,sheets or bars;(v)rock crushing; <br /> (vi) foundry; and (vii) laboratory. <br /> 24. Various local, state, and federal agencies have evaluated RFES' Facility and <br /> concluded that the Facility is either compliant with the standards and requirements that each of the <br /> agencies oversees or that RFES' operations do not fall within the agencies' regulatory jurisdiction. <br /> Agencies with whom RFES has communicated include the Mine Safety and Health <br /> Administration, EPA, the Department of Homeland Security, the Colorado Department of Public <br /> Health and Environment, Ralston Valley Water and Sanitation District, the City of Arvada water <br /> and sewer department, and Jefferson County Planning and Zoning. <br /> - 4- <br /> 4884-8560-1078.2 <br />
