Failure to address the corrective actions by the deadline may cause the <br /> Division to escalate the Problem to a Possible Violation (PV) and schedule the issue for formal hearing before <br /> the Mined Land Reclamation Board (Board). <br /> INSPECTION TOPIC: Slides & Other Damage <br /> POSSIBLE VIOLATION: Based on the self-reported details and the Divisions observations, the slide event is <br /> cited as a possible violation pursuant to Rule 3.1.5(3), C.R.S. 34-32.5-116(4)(i), and C.R.S. 34-32.5-124. Mining <br /> occurred in a way that resulted in destabilized highwalls and failed to control erosion and sedimentation on the <br /> affected lands. Mitigation of the rockslide to stabilize the highwall and reclaim the surrounding area will <br /> require an impact to areas outside of the affected lands. <br /> CORRECTIVE ACTIONS: This possible violation will require a hearing before the Mined Land Reclamation <br /> Board. The schedule and other details for the MLRB hearing will be provided in a separate document, a Reason <br /> to Believe a Violation Exists letter which will be sent via certified mail. <br /> CORRECTIVE ACTION DUE DATE: 3/22/23 <br /> Page 1 of 9 <br />
