Syracuse Way,Suite 450 <br /> Greenwood Village,CO 80111 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing; <br /> Mid-Continent LST; Permit No. M-1982-121 <br /> Mr, Wagner: <br /> On January 23, 2023,the Division of Reclamation Mining and Safety(Division)conducted an inspection <br /> of the Mid-Continent LST(Permit.No M-1982-121)in response to the landslide reported to the Division <br /> on January 19,2023. As outlined in the Division's inspection report dated January 25,2023,the Division <br /> found the following: <br /> Based on the details provided by the Operator, and the Division's independent observations, the <br /> slide event is cited as a possible violation pursuant to Rule 3.1.5(3), C.R.S. 34-32.5-116(4)(i), <br /> and C.R.S. 34-32.5-124. Mining occurred in a way that resulted in destabilized highwalls, and <br /> failed to control erosion and sedimentation on the affected lands. Mitigation of the rockslide to <br /> stabilize the highwall and reclaim the surrounding area will require an impact to areas outside of <br /> the affected lands. <br /> Therefore,the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act <br /> for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et_seq., and the provisions of your <br /> Permit No. M-1982-121,and has scheduled this matter to appear before the Board. <br /> A Formal Public Hearing before the Mined Land Reclamation Board(the"Board")has been scheduled <br /> during the March 22-23, 2023 Board meeting.The hearing will be held at 1313 Sherman Street,Room <br /> 318, Denver,Colorado,beginning at 9:00 a.m. on March 22 or as soon thereafter as the matter can be <br /> considered. D[U damns mlrb-submittalsrC4state.co.us. <br /> In order to be considered at the hearing,all exhibits,materials and witness testimony you wish for the <br /> Board to consider must be submitted by 5:00 PM on March 10, 2023 via email to the Board <br /> Administrator.
