COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> January 25,2023 <br /> Mary Vasquez <br /> 750 Crisman Dr. <br /> Apt A201 <br /> Longmont, CO 80501 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing; Perdue; Permit No. M-2000-089 <br /> Ms.Vasquez: <br /> On December 16,2022,the Mined Land Reclamation Board (Board) issued their Findings of Fact, Conclusions <br /> of Law, and Order for Violation No. MV-2022-018, Attachment 1. This Order included a required corrective <br /> action for Mary Vasquez (Operator) to submit an amendment to the current financial warranty for the <br /> additional amount of $3,272.00 or submit a new financial warranty reflecting the increase, to a total of <br /> $15,772.00 within 30 days of the Board Order or January 15, 2023. The Operator was assessed a total civil <br /> penalty of$22,000.00 with all but$500.00 suspended if the Operator complied within 30 days of the Board <br /> Order or January 15,2023.Additionally, pursuant to C.R.S. 34-32.5-116(3)(a)and (b) and Permit No. M-2000- <br /> 089 requires you to submit to the Division an annual fee, map and report, due on or before October 4 of each <br /> year. The annual fee required for your permit is $323.00. As of the date of this letter the Division has not <br /> received your submittal. <br /> As of the date of this letter, the Division of Reclamation, Mining and Safety Division (Division/DRMS) has not <br /> received the required increase in financial warranty or the unsuspended civil penalty. <br /> The Division believes this is a violation of: <br /> ■ C.R.S. 34-32.5-124 for failure to comply with the conditions of an order, permit, or regulation. <br /> and <br /> ■ C.R.S. 34-32.5-116(3)(a) and (b)for failure to submit the required annual report, map, and fee. <br /> Therefore,the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act for <br /> the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et seg., and the provisions of your Permit No. <br /> M-2000-089, and has scheduled this matter to appear before the Board. <br /> Op COS <br /> 1001 E 62"d Ave, Denver CO 80216 1 P 303.866.3567, F 303.832.8106 1 https://drms.cotorado.gov90 <br /> Jared S.
