Box 875 <br />Westcliffe, CO 81252 <br /> <br /> <br />Re: Buffalo Hunter Lode - File No. M-2016-015 <br /> Lucky VI Quarry <br /> Acreage Release Request (AR-1) <br /> Acreage Reduction (Partial Release of 3.16 acres) <br /> <br />Dear Ed Lyons: <br /> <br />On January 25, 2023 the Division of Reclamation, Mining and Safety concluded its review of the <br />Acreage Release Request application submitted to the Division on December 2, 2022, addressing the <br />following: <br /> <br />Release 3.16 acres from Buffalo Hunter Lode (M2016 -015) that are now permitted under the adjacent <br />Black Obsidian permit (M1987 -026) to eliminate permit overlap. <br /> <br />The decision reached by the Division is: Approve. 3.16 acres released from west side of Lucky VI <br />Quarry will now be permitted under the adjacent Black Obsidian Quarry (M1987 -026). 6.34 <br />permitted acres remain in Lucky VI Quarry. In accordance with Rule 4.17.2(5), the Division is <br />required to wait thirty (30) days from this notice to allow for appeal of the Division’s decision. Once <br />this period closes, if no appeal is submitted, the Division’s decision will be final. <br /> <br />The permit area was reduced to 6.34 acres, through the release of -3.16 acres in this permit action. <br />Because the permit is not totally released, you are still liable for filing annual reports and fees. Please <br />submit a Technical Revision and update the mining and reclamation plan maps to depict the reduced <br />permit area. <br /> <br /> <br />Bond Held: $32,800.00 <br />Prior Liability: $32,800.00 <br />Change in Liability: $0.00 <br />Revised Liability: $32,800.00 <br />Prior Permit Acreage: 9.50
