Based on the figures shown in Table 3,the minimum amount of bond
to be held following the approval of SL-7 is $1,579,960.16.
(ii) The site-wide reclamation cost estimate was last recalculated with MT-8/SR-2 in 2021, and
subsequently adjusted with SL-6. The approval of SL-7 will impact tasks 16, 121 and 122 from
that estimate, as shown in Table 4. Since those tasks were reduced considerably with MT-
8/SR-2, the dollar amount associated with them is rather small. Although the acreage
associated with task 16 is not exactly the same as that released with SL-7 (20.74 acres
compared to 21.24 acres), they are very close. For the purposes of SL-7 the Division will
subtract the value of task 16 from the estimated cost to reclaim the site calculated with SL-6;
based on this calculation, the estimated remaining cost to reclaim the mine disturbance is
$1,690,969.00, which exceeds the minimum amount of bond to be held from Table 3.
Following the issuance of SL-7 the new required surety for the Elk Creek Mine will be $1,690,969.00
Any person with a valid legal interest which might be adversely affected by this proposed decision may
request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule
3.03.2(6). Public notice of this proposed decision will be published twice in the Delta County Independent
as soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty
days of the day following the first publication in the Delta County Independent. If no hearing is requested
within those thirty days,the Division's decision will become final.
C-1981-022,SL-7 Page 8 of 9
