• 1000LORADO <br /> -w Division of Reclamation, <br /> ® Mining and Safety <br /> Department of Natural Resources <br /> January 18, 2023 <br /> Delta County Commissioners <br /> County Commissioner <br /> 501 Palmer Street, 9227 <br /> Delta, CO 81416 <br /> Re: Elk Creek Mine(Permit No. C-1981-022) <br /> Bond Release Application No. 7 (SL-7) <br /> Dear Delta County Commissioners: <br /> This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined <br /> Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, <br /> Mining and Safety has issued a proposed decision to approve Bond Release Application No. 7 for <br /> the Elk Creek Mine. This decision will be published in the Delta County Independent as soon as <br /> possible. The first day following publication of the notice initiates a thirty(30) day public comment <br /> period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will <br /> become final. <br /> SL-7 releases 21.24 acres of GVB pads and roads from all reclamation liability. With SL-7 an <br /> error made in SL-3, where 0.62 acres were mistakenly given Phase II release, is also corrected. <br /> SL-7 does not release any Phase II acreage. As an interested party, you have the right to an <br /> adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. The request <br /> for an adjudicatory hearing must be written and state with specificity the reasons why the hearing <br /> is requested.
