• 1000LORADO -w Division of Reclamation, ® Mining and Safety Department of Natural Resources January 18, 2023 Delta County Commissioners County Commissioner 501 Palmer Street, 9227 Delta, CO 81416 Re: Elk Creek Mine(Permit No. C-1981-022) Bond Release Application No. 7 (SL-7) Dear Delta County Commissioners: This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, Mining and Safety has issued a proposed decision to approve Bond Release Application No. 7 for the Elk Creek Mine. This decision will be published in the Delta County Independent as soon as possible. The first day following publication of the notice initiates a thirty(30) day public comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will become final. SL-7 releases 21.24 acres of GVB pads and roads from all reclamation liability. With SL-7 an error made in SL-3, where 0.62 acres were mistakenly given Phase II release, is also corrected. SL-7 does not release any Phase II acreage. As an interested party, you have the right to an adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written and state with specificity the reasons why the hearing is requested. The request must be received within thirty days of the day following the first publication of the proposed decision in the Delta County Independent.
