The permit renewal application,all supporting documentation, and any stipulations or conditions will <br /> become a binding part of the permit. <br /> Summary <br /> The Review Process <br /> In a letter dated July 2,2021,BRL was informed by the Division that the current five year permit term will <br /> expire on April 4, 2022 and that the RN-05 application was due on or before October 6, 2021. BRL <br /> submitted a complete permit renewal package on September 23,2021. The renewal was deemed complete <br /> on September 27,2021, and completeness letters were sent out by the Division on the same day. A public <br /> notice was published four times in the Delta County Independent in December 2021 (December 1, 8, 15 <br /> and 22) stating that a complete application was filed with the Division. <br /> The Division sent a Preliminary Adequacy Review adequacy review letter to BRL dated November 24, <br /> 2021. The response from BRL's representative was received on March 21,2022. This response addressed <br /> all of the adequacy concerns. <br /> The Bureau of Land Management's (BLM)Uncompahgre Field Office conducted an Environmental <br /> Assessment for the Bowie Coal Lease Modification Application (August 2012). The EA included an <br /> informal Section 7 consultation request(November 30,2011)to the U.S. Fish and Wildlife Service <br /> (USFWS)regarding potential effects on threatened and endangered species. OSM determined on <br /> December 18,2012 that the Bowie No.2 Mine is not likely to jeopardize the continued existence of listed <br /> species or result in the destruction or adverse modification of designated critical habitat. Information <br /> related to the environmental assessment was incorporated into the Permit with Permit Revision No. 13, <br /> approved on April 4,2013. <br /> The need for an updated Section 7 consultation was considered as part of RN-05. The Division sent a <br /> letter to the USFWS(dated January 13,2022),requesting an opinion on the need for another Section 7 <br /> consultation. In email correspondence from the USFWS (March 16,2022),they indicated that a <br /> consultation is not required unless the Division believes that mine activities will impact federally listed <br /> species. The Division does not believe that deleterious impacts will occur. <br /> Description of the Environment <br /> The Bowie No.2 coal mine permit area includes 10,987.4 surface acres, of which 5,262.9 surface acres <br /> are federally owned and 5,724.5 acres are privately owned. The coal and the surface lands within the <br /> present permit area are both federally and privately owned, as are the surface areas that have been <br /> disturbed by surface developments. The total approved disturbed area by surface operations is 404.22 <br /> acres. <br /> The Bowie No.2 Mine is located in Delta County,approximately five miles northeast of Paoma, <br /> Colorado. The mine permit area is located on lands depicted on the U. S. Geological Survey 7.5 minute <br /> 4 <br />
