B. The Division waived the requirement for clearing of small shrub and grass-type <br /> vegetation cover prior to topsoil removal. The applicant has demonstrated that inclusion <br /> of vegetation cover in salvaged topsoil is not detrimental to soil productivity consistent <br /> with the post-mining land use. Large tree and shrub vegetation was removed prior to <br /> topsoil salvage. <br /> C. The Division has determined that the 'A'and B'horizons shall be removed together and <br /> replaced,in order to ensure soil productivity consistent with the approved post-mining <br /> land use (4.06.2(3)). <br /> D. The Division has not determined that selected overburden materials shall be used for or <br /> as a supplement to topsoil (4.06.2(4)(a)). <br /> V. Sealing of Drilled Holes and Underground Openings <br /> A. The applicant has not proposed to manage development,exploration,drill or bore holes, <br /> wells or other exposed underground openings in a manner other than by sealing and <br /> plugging(4.07.1). <br /> B. The Division will require that each hole,well or other underground opening be capped, <br /> scaled,backfilled,or otherwise properly managed (4.07.3). <br /> VI. Use of Explosives <br /> A. The Division does not propose to approve a blasting area in excess of 300 acres <br /> (4.08.3(2)(b)(1)). <br /> B. The Division does not propose to approve blasting at times other than those described in <br /> the blasting schedule (4.08.3(2)(b)(v)and 4.08.4(2)). <br /> C. The applicant has not proposed to conduct blasting less than 1000 feet from a school, <br /> church,hospital,or nursing facility, or less than 500 feet from disposal wells,petroleum <br /> or gas storage facilities,municipal water-storage facilities, fluid-transmission pipelines, <br /> gas or oil collection lines, or water or sewage lines(4.08.4(7)). <br /> D. The Division is not proposing to approve the use of a modified equation to determine <br /> maximum weight of explosives per delay(4.08.6(2)). <br /> VII. Disposal of Excess Spoil <br /> This section does not apply to the Bowie No. 2 Mine permit application. All excess material <br /> generated during surface construction or during underground mining is considered to be coal mine <br /> waste,and such materials will be placed in the approved coal mine waste bank. <br /> VIIL Coal Mine Waste Banks <br /> A. The Division approved plans for use, construction and maintenance of a coal mine waste <br /> disposal area(4.10.1(1)). <br /> 21 <br />
