2. The landowner has not requested the retention of the access roads depicted on <br /> Maps 15-1 and 15-2. Therefore,the access roads will be reclaimed (4.03.2(1)(f)). <br /> 3. The Division does not propose to approve the location of a portion of an access <br /> road in the channel of a stream(4.03.2(2)(b)). <br /> 4. The Division does not propose to approve access road cut slopes steeper than <br /> 1.5H:1 V or 0.25H:1 V(4.03.2(3)(c)(1)). <br /> 5. The Division does not propose to approve an access road embankment slope <br /> steeper than 1.35H:1 V(4.03.2(3)(d)(viii)). <br /> C. Light-Use Roads <br /> 1. The Division does not propose to approve the location of a portion of a light-use <br /> road in the channel of an ephemeral stream with an upstream watershed of at <br /> least one square mile,an intermittent or a perennial stream(4.03.3(2)(b)). <br /> 2. The Division does not propose to approve a ford of an intermittent,a perennial or <br /> an ephemeral stream,which drains at least one square mile. Fords will be <br /> allowed across ephemeral streams with a watershed less than one square mile. <br /> The Division finds that the fords will not affect stream sedimentation or fish, <br /> wildlife,and related values due to light and infrequent use. <br /> 3. All but one of the current light-use roads are pre-existing roads and will be <br /> retained after reclamation of the Bowie No. 2 Mine site. Stipulation No. 13, <br /> attached to the proposed decision for Permit Revision No. 6,required,in part,the <br /> submittal of the CDOT road use permit for a light use road that was to be used <br /> for access to the west side of the loadout. However,the temporary light use road <br /> was never constructed and the proposed acreage disturbance was removed from <br /> the permit in Technical Revision No. 31. Two additional light use roads were <br /> approved in Permit Revision No. 7. Both allow access to two new material <br /> storage areas. <br /> IL Support Facilities <br /> Construction of support facilities will not result in change, destruction or disruption of oil, gas <br /> pipelines or water wells, nor will coal slurry pipelines or railroads be impacted. Therefore, the <br /> Division approved those activities(4.04(6)). A list of approved facilities may be found in Section <br /> 2.05.3(3)of the permit. <br /> III. Hydrologic Balance <br /> A. Water Quality Standards and Effluent Limitations <br /> 1. The Division granted approval for small area exemptions from the use of <br /> sediment ponds,due to the limited size of the areas and due to the fact that ponds <br /> and treatment facilities are not necessary for the drainage to meet the effluent <br /> limitations of Rule 4.05.2 and applicable State and Federal water quality <br /> standards for receiving streams, and also due to the fact that no mixing of surface <br /> 17 <br />
