<br /> THIS GENERAL WARRANTY DEED is dated as of September /3, 2019, between
<br /> MALONE RANCH. LLC, a Colorado limited liability company, and R & B RANCH, LLC, a
<br /> Colorado limited liability company (collectively, "Grantor'), and SCOTT CONTRACTING,
<br /> INC., a Colorado corporation ("Grantee"), whose address is 9200 E. Mineral Avenue, 4400,
<br /> Centennial, Colorado 80112.
<br /> WITNESS, that Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and
<br /> other good and valuable consideration, the receipt and sufficiency of which is hereby
<br /> acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant,
<br /> bargain. sell, convey and confirm unto Grantee, its successors and assigns forever, all of that
<br /> certain real property in the County of Garfield, State of Colorado that is legally described on
<br /> Exhibit A attached hereto and incorporated herein by this reference (the "Property");
<br /> TOGETHER with all and singular of Grantor's right, title and interest in and to easements,
<br /> rights-of-way, development rights, appurtenances and hereditaments appertaining to or otherwise
<br /> benefiting or used in connection thereof; and all water and water rights, all mineral rights for oil
<br /> and gas (to the extent owned by Grantor), and all sand, gravel and rights in and to any sand and
<br /> gravel located at, on or under the Property; and the reversion and reversions, remainder and
<br /> remainders, rents, issues and profits thereof; and all the estate, right, title. interest, claim and
<br /> demand whatsoever of Grantor,either in law or equity,of, in and to the above-bargained Property;
<br /> TO HAVE AND TO HOLD the Property unto Grantee, its successors and assigns forever.
<br /> Each Grantor, for itself and its successors and assigns, does covenant and agree that it shall and
<br /> will warrant and forever defend the Property in the quiet and peaceable possession by Grantee, its
<br /> successors and assigns, against all and every person or persons who lawfully claims the whole or
<br /> any part thereof, subject to those items set forth on Exhibit B attached hereto and incorporated
<br /> herein.
