(Kiewit) is submitting the enclosed Request for Full or Partial Release <br /> of Permit Area/ Reduction form and corresponding attachments in support of a request to <br /> release 289.2 acres from the current Reclamation Plan and Permit for Fountain Colony Pit(Permit <br /> #M-1987-171) located in El Paso County,Colorado. <br /> In support of this partial release request,the following site map and Exhibits are included hereto <br /> that depict the release area and new permit and affected land boundary conditions upon approval <br /> of the release: <br /> • Site Map-Permit and Affected Land Area Proposed for Release <br /> • Exhibit C-Mining Plan Map <br /> • Exhibit F- Reclamation Plan Map <br /> Additionally, we have included a copy of the Kiewit/Copart, Inc. (Copart) Post Closing Mining <br /> Permit and Reclamation Plan Obligations - Kiewit Continuing Access letter after the sale dated <br /> November 29, 2022. The letter outlines the Purchase and Sale Agreement (Agreement) between <br /> Kiewit and Copart to allow Kiewit access to the 320-acre parcel recently sold to Copart. This <br /> Agreement allows Kiewit to continue accessing the site for reclamation responsibilities under the <br /> mining permit. <br /> The release area of 289.2 acres as requested in this submittal package includes the entirety of <br /> mining and reclamation areas Phase I, Phase II, Phase III, and Phase IV, which were recently <br /> acquired by Copart as part of an industrial/commercial development project,and for which 12.5 <br /> acres will be leased back to Kiewit for equipment storage purposes.Additionally,the release area <br /> includes the access road alignment and adjoining land in Phase V, which will be used by both <br /> Kiewit and Copart to access the site for reclamation and development purposes,respectively.The <br /> KIEWIT CORPORATION <br /> 1550 Mike Fahey Street, Omaha,NE 68102 <br /> (402)943-1349 PHONE (402)271-2830 FAX <br />
