Pits. <br /> MR-242 MR-242 incorporated two light-use roads adjacent to the Collom Haul Road for <br /> access to monitor and maintain several small sediment sumps. <br /> MR-243 MR-243 incorporated a topsoil windrow on the west crest of Little Collom Gulch <br /> within the Collom Pit. <br /> MR-244 MR-244 incorporated an updated certificate of insurance for the Colowyo Mine. <br /> MR-245 MR-245 revised the mine plan timing for the South Taylor Pit, and provides <br /> documentation of a wildfire that occurred within the mine permit boundary. <br /> 3.5 Status of Violations <br /> The Division has issued one Notice of Violation (NOV), for Violation No. CV-2022-001, since <br /> approval of Permit Renewal No. 7. Violation No. CV-2022-001 was abated on January 3, 2023 <br /> after Colowyo addressed all requirements of the NOV. <br /> 3.6 Applicant/Violator System <br /> Applicant/Violator System (AVS) checks were completed on June 7, 2022 and August 18, 2022. <br /> Another check will be made after the proposed decision and before issuance of the permit. <br /> 3.7 Proposed Decision Date <br /> A Decision date of January 5, 2023 on the renewal application is based on this findings <br /> document. <br /> 3.8 Public Notification of Proposed Approval and Issuance of the Revision <br /> Notice of the Proposed Decision will be published once a week for two consecutive weeks in the <br /> Craig Daily Press and Rio Blanco Herald Times (Rule 2.07.4(2)(d)). Notification letters of the <br /> Decision will be sent to: Colowyo (Rules 2.07.4(2)(c) and 2.08.5(3)(b)); OSM, Western <br /> Regional Coordinating Center (Rules 2.07.4(2)(c) and 2.08.5(3)(b)); the Office of Archaeology & <br /> Historic Preservation; the surface and mineral owners of record of the affected land (BLM and <br /> the State Board of Land Commissioners); and to the Moffat and Rio Blanco County <br /> Commissioners (Rule 2.08.5(3)(b)). <br /> If no objections are received within 30 days of the first publication (Rule 2.07.4(3)(a)), and with <br /> clearance of the final AVS check, the proposed decision will be issued and considered final <br /> within five days of the close of the public comment period (Rule 2.07.4(3)(c)). <br /> Proposed Decision and Findings of Compliance January 5,2023 <br /> Permit Renewal No. 8 P a g e 115 <br />
