<br /> acknowledged, hereby sells and conveys to MARTIN MARIETTA MATERIALS REAL

<br /> address is 1627 Cole Boulevard, Suite 200,Lakewood,Colorado 80401,all of Grantor's right,title
<br /> and interest in and to the real property in the County of Pueblo, State of Colorado,that is described
<br /> on Exhibit A attached hereto and made a part hereof (the "Property"), together with all of
<br /> Grantor's right, title and interest in and to (i) all improvements, structures and futures placed,
<br /> constructed or installed on the Property; (ii) any and all easements, rights. benefits, privileges,
<br /> easements,tenements,and appurtenances thereon or in any mannerappertaining thereto,including;
<br /> Without limitation,any right,title,and interest of Grantor, if any, in and to adjacent streets,alleys,
<br /> casements, and rights-of-way; and (iii) all mineral rights, including sand, gravel, aggregate,
<br /> granite, and limestone minerals;but excluding any water and water rights, which are granted and
<br /> conveyed to Grantee by separate Bargain and Sale Deed executed contemporaneously herewith.
<br /> TO hIAVE AND TO HOLD the Property, together with all and singular the rights and
<br /> appurtenances thereto in anywise belonging,unto Grantee, its Successors and assigns forever;and
<br /> Grantor does hereby bind itself and its successors and assigns to WARRANT AND FOREVER
<br /> DEFEND all and singular the Property unto Grantee, its successors and assigns, against every
<br /> person whomsoever lawfully claiming or to claim the same or any part thereof by,through or under
