Box 628 <br /> 27646 West 5th Avenue <br /> Nucla, CO 81424 <br /> RE: New Horizon Mine, Permit No. C-1981-008 <br /> 1" Quarter 2022 Discharge Monitoring Reports Review <br /> Dear Tony, <br /> The Colorado Division of Reclamation, Mining and Safety (the Division) has finished <br /> reviewing the 2022 1st Quarter Discharge Monitoring Reports (DMRs). The reports were <br /> received on February 24, 2022 (January Report), March 28, 2022 (February Report), and <br /> May 2, 2022 (March and quarterly Report). The Division finds the reports to be in <br /> compliance with the following Rules: <br /> - Rule 4.05.13(2)(i)— Samples are measured accurately and record the quality and <br /> quantity of the water discharged from the permit area. <br /> - Rule 4.05.13(2)(ii)—Discharges occurred from 013-A in January, February and <br /> March of 2022. Parameters testes were within acceptable value ranges, except for <br /> one WET Testing Value. WET Testing for the reproduction of Ceriodaphnia <br /> failed in the 1st quarter. The Division is working with the Operator to submit a <br /> future Technical Revision to address this issue. Outfalls 12-A and 016-A did not <br /> discharge during the quarter; therefore, no exceedances occurred at these <br /> monitoring locations <br /> - Rule 4.05.13(2)(iii)—Discharge Monitoring Reports are received on a quarterly <br /> basis and filed with the Division within 90 days of the sample collection. <br /> This concludes the Division's review of the 2022 1st Quarter Discharge Monitoring <br /> Reports.
