Therefore, the Applicant obtained approval of an amendment to the <br /> reclamation mining permit from DRMS to allow for backfilling of the pit. <br /> The current financial warranty posted for the site is $368,590, which was set by DRMS after approving an <br /> amendment request to change the reclamation plan from water storage to an inert backfill operation on <br /> the property (to two feet above the water table). This action satisfied the requirement that the Applicant <br /> diligently pursue compliance with their DRMS permit and the requirements described in the April 30, 2010 <br /> letter DRMS sent to all gravel pit operators (attached), specifically in regard to the required financial <br /> warranty at the site. With each successive SWSP renewal request, the Applicant shall demonstrate <br /> continued diligence in this effort, including maintaining satisfactory status in obtaining proper bonds <br /> through DRMS. <br /> Conditions of Approval <br /> This substitute water supply plan is hereby approved in accordance with section 37-90-137(11), C.R.S. and <br /> subject to the following conditions: <br /> 1. This SWSP is approved with the effective date of November 1, 2022 and shall be valid through <br /> October 31, 2023 unless otherwise revoked or superseded by a decree. If this plan is not decreed <br /> in water court by the SWSP expiration date, a renewal request must be submitted to this office with <br /> the statutory fee of $257 no later than September 15, 2023. If a renewal request is received <br /> after the expiration date of this plan, it will be considered a request for a new SWSP and a filing <br /> fee of$1,593 will be required. <br /> 2. The total surface area of the groundwater exposed at the site must not exceed 0.12 acres <br /> resulting in annual evaporative losses of 0.35 acre-feet during the approval period of this SWSP. <br /> 3. This SWSP does not permit any water use for dust control, aggregate production, or any other <br /> purpose, other than evaporation. <br /> 4. Total consumption at the site must not exceed the aforementioned amounts unless an amendment <br /> is made to this plan. <br /> 5. Well permit no. 57723-F is in good standing for the current use and exposed surface area at the site <br /> in accordance with sections 37-90-137(2) and (11), C.R.S. <br /> 6. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must <br /> first be approved by this office. <br /> 7. All releases of replacement water must be sufficient to cover all out-of-priority depletions in time, <br /> place, and amount and should be made on a daily basis. The release of monthly replacement water <br /> may be aggregated in a single release to maximize beneficial use at the direction and approval of <br /> the Water Commissioner. <br /> 8. Conveyance loss for delivery of augmentation water to the South Platte River is subject to <br /> assessment and modification as determined by the Division Engineer. Currently, conveyance losses <br /> are being assessed at 5.39% (0.5% per mile) during the irrigation season (April through October) and <br /> 2.7% (0.25% per mile) during the non-irrigation season (November through March). <br /> 9. The Applicant shall provide daily accounting (including, but not limited to depletions, replacement <br /> sources, and river calls) on a monthly basis. The accounting must be uploaded to the CDSS Online <br /> Reporting Tool within 30 days of the end of the month for which the accounting applies <br /> (https://dwr.state.co.us/Tools/reporting).
