Box 1 <br />Cortez, , CO 81321 <br /> <br />Re: La Plata Project - File No. P-2022-014 <br /> Metallic Minerals US Inc. <br /> Notice of Intent to Conduct Mineral Prospecting <br /> <br />Dear Scott Petsel: <br />The Division of Reclamation, Mining and Safety (Division) has completed its review and has denied <br />your Notice of Intent to Conduct Mineral Prospecting Operations (NOI) submitted for La Plata <br />Project, File No. P-2022-014. <br /> <br />A financial waranty never submitted. The consultant stated that the operator wished to withdraw the <br />aplication, but the Division has never received the request from the operator. <br /> <br />Pursuant to Rule 5.1.3(d)(iv), the Division’s determination will not take effect until the expiration of <br />the five business days allowed for an appeal, or in the case of an appeal, until the Mined Land <br />Reclamation Board issues its decision. <br /> <br />A prospective Person conducting exploration may appeal an Office determination within five (5) <br />business days from the date the Office sends notice of its decision. The Board shall hear any such <br />appeal at its next regularly scheduled meeting that is at least ten (10) calendar days from the date of <br />such appeal. The appeal should state how you are directly and adversely affected or aggrieved by the <br />Office’s decision, and how your interests are entitled to protection under the Act. The appeal should <br />list and explain any issues you believe should be considered by the Board at the Hearing on the <br />matter.
