Notice of Intent to Conduct Mineral Prospecting

Dear Scott Petsel:
The Division of Reclamation, Mining and Safety (Division) has completed its review and has denied
your Notice of Intent to Conduct Mineral Prospecting Operations (NOI) submitted for La Plata
Project, File No. P-2022-014.

A financial waranty never submitted. The consultant stated that the operator wished to withdraw the
aplication, but the Division has never received the request from the operator.

Pursuant to Rule 5.1.3(d)(iv), the Division’s determination will not take effect until the expiration of
the five business days allowed for an appeal, or in the case of an appeal, until the Mined Land
Reclamation Board issues its decision.

A prospective Person conducting exploration may appeal an Office determination within five (5)
business days from the date the Office sends notice of its decision. The Board shall hear any such
appeal at its next regularly scheduled meeting that is at least ten (10) calendar days from the date of
such appeal. The appeal should state how you are directly and adversely affected or aggrieved by the
Office’s decision, and how your interests are entitled to protection under the Act. The appeal should
list and explain any issues you believe should be considered by the Board at the Hearing on the
matter. The appeal should specifically state the application or file number assigned by the Office (P-
2022-014).
