Upon the approval of the <br /> 4.3-acre reduction, the new acreage for the affected lands in the area would be 10.5 acres. <br /> Background <br /> In response to the observation of an unmarked boundary during a routine inspection by the <br /> Division, CC&V representatives committed to submitting a technical revision to delineate the <br /> affected lands boundary at the Carlton Tunnel. The technical revision was submitted to DRMS <br /> on September 30, 2020, and approved by the Division on November 18, 2020. <br /> As a follow-up action to close out the finding, CC&V inadvertently staked the boundary in the <br /> wrong location, and as a result, a third-party landowner filed CT-04 with DRMS in December of <br /> 2020. <br /> On August 16, 2021, CC&V submitted AR5 along with an addendum to TR-124 for the <br /> reduction of 4.3 acres at the Carlton Tunnel to address the landowner's complaint. This <br /> addendum to TR-124 required the landowner's acknowledgment regarding the release, however <br /> the formal acknowledgment was never received. In early February 2022, the Division gave <br /> CC&V the approval to proceed with AR5 without the landowner's acknowledgment, and <br />
