<br /> <br /> <br /> <br /> <br /> <br />December 18, 2022 <br /> <br /> <br />Chance Allen <br />Holcim - WCR, Inc. <br />1687 Cole Blvd., Suite 300 <br />Golden, CO 80401 <br /> <br /> <br />Re: Longmont Operation - File No. M-1994-027 <br /> Holcim - WCR, Inc. <br /> Technical Revision (TR-3) <br /> Technical Revision Request - Reclamation Plan <br /> <br />Dear Chance Allen: <br /> <br />On December 18, 2022 the Division of Reclamation, Mining and Safety concluded its review of the <br />Technical Revision application submitted to the Division on December 5, 2022, addressing the <br />following: <br /> <br />Technical Revision Request - Revised Post-Mining Land Use from Wildlife Habitat to Recreation by <br />the backfilling of the excavated areas by Holcim and the City of Longmont. <br /> <br />The Division considers a change in the post-mining land use a significant revision to the approved <br />Reclamation Plan. Pursuant to Rule 1.1(6), an “Amendment” means a change in the permit or an <br />application which increases the acreage of the affected land, or which has a significant effect upon the <br />approved or proposed Mining Plan or Reclamation Plan. The Division will require the Operator to <br />submit an amendment application to revise the post-mining land use. <br /> <br />The decision reached by the Division is: deny. <br /> <br />In accordance with Rule 1.4.11, any person who can demonstrate that they are directly and adversely <br />affected or aggrieved by an action of the Office, may petition for a hearing before the Board on such <br />action within thirty (30) days of the date of the Office decision, if the decision was a denial, without a <br />hearing. Such petitions for a hearing shall state how the petitioner is directly and adversely affected or <br />aggrieved by the Office’s decision, and how the petitioner’s interests are entitled to protection under <br />the Act. The petitioner shall list and explain any issue the petitioner believes should be considered by <br />the Board at the hearing on the matter.
