aCOLORADO
Division of Reclamation,
®_ Mining and Safety
Department of Natural Resources
December 14,2022
Donald G.Wacker,President
Ogilvy Irrigating and Land Company
822 7 h Street, Suite 760
Greeley,CO 80631
Re: Loloff Mine,File No.M-1985-112,
Response to letter related to maintenance and reclamation of pit slopes
Dear Mr.Wacker:
On December 8,2022,the Division of Reclamation,Mining and Safety(DRMS)received a letter from you
explaining that vegetation of the slopes of the Loloff Mine pit is problematic due to the need to access the
slopes for grading of erosion features on the slopes. Thank you for explaining your position on this topic.
I have discussed this with my supervisor,Michael Cunningham, and we think that the permittee for this site,
Loloff Construction,Inc.,can revise the reclamation plan to remove the requirement for vegetation on the
slopes. This can be accomplished with a Technical Revision to the permit. Some considerations:
• Vegetation should be established on the flat portions of the site, above the slopes, where there is no
road or other hard surface.
• Stability of the slopes must be maintained. Minor rills are acceptable (if they are addressed by
maintenance actions),but greater damage must be avoided to maintain compliance.
If you have any questions, please contact me by telephone at 720-601-2276, or by email at
Rob.zuber@state.co.us.
Sincerely,
Robert D.Zuber,P.E.
Environmental Protection Specialist
Copied: J.C.
