PERMIT#:M-2022-051 <br /> INSPECTOR'S INITIALS:ACY <br /> INSPECTION DATE:December 6,2022 <br /> seeded. It was discussed that since building on the pad area is desired that this area will be stabilized but not <br /> seeded or topsoiled. <br /> The southern borrow area is mid-mining. Topsoil has also been stockpiled at the top of the slope. Several <br /> interstitial benches and small stockpiles remain on the slope. This area will be worked in the spring when site <br /> activity recommences. No additional disturbances beyond the existing footprint are anticipated. Once <br /> excavated borrow material concludes, the southern slope will also be topsoiled and seeded with a pad left <br /> bare to support future site development. <br /> Mr. Roberts indicated that a road was preexisting that paralleled highway 13 and connected the gates of Mr. <br /> Collett's property and entrance to the neighboring property to the south. Without a pre-operational inspection <br /> the Division cannot attest to the road conditions/specifications prior to commencement of this project. A wire <br /> fence runs parallel to Highway 13. Additionally a powerline also parallels the highway inside (east) of the fence <br /> with a spur that bisects the two excavation areas. A small (approx. 20 CY) pile of large boulders as well as a <br /> snow-covered stockpile were located on the pad of the northern excavation area. Two dozers were on site. All <br /> other equipment, fuel, structures and other miscellaneous features have been removed from the site. <br /> Based on discussions with the Operator and the observations of the site inspection the Division has <br /> determined and affirmed its original finding that a permit is necessary. This is cited as a possible violation of <br /> C.R.S. 34-32.5-109(1) for failure to obtain a reclamation permit prior to engaging in a new mining operation. <br /> This possible violation will require a hearing before the Mined Land Reclamation Board. The schedule and <br /> other details for the MLRB hearing will be provided in a separate document, a Reason to Believe a Violation <br /> Exists letter which will be sent via certified mail. If at the hearing a violation is found the Operator will be <br /> required to submit a permit application and gain approval from the Division within all statutory deadlines. The <br /> Operator is encouraged to submit an application prior to the January 25, 2023 MLRB Meeting. <br /> To date the Division has not received any complaints from the public regarding this site. Nor has a permit <br /> application been submitted.
