<br /> <br /> <br /> <br /> <br /> <br />December 6, 2022 <br /> <br /> <br />Alan Lincoln <br />Kiewit Infrastructure Co. <br />1550 Milke Fahey St <br />Omaha, NE 68102 <br /> <br /> <br />Re: Fountain Colony Pit - File No. M-1987-171 <br /> Kiewit Infrastructure Co. <br /> Technical Revision (TR-5) <br /> Delineate Industrial/Commercial Land Use Area <br /> <br />Dear Alan Lincoln: <br /> <br />On December 6, 2022 the Division of Reclamation, Mining and Safety concluded its review of the <br />Technical Revision application submitted to the Division on November 8, 2022, addressing the <br />following: <br /> <br />The objective of this TR is to delineate which areas are to be designated industrial/commercial and <br />which are to be rangeland for the post-mine land use. <br /> <br />The decision reached by the Division is: approve. <br />The requirements for marking any remaining affected area boundaries (Rule 3.1.12(2)) will be <br />determined during any subsequent inspections related to future release requests. <br /> <br />The terms of Technical Revision No. 5 approved by the Division are hereby incorporated into Permit <br />No. M-1987-171. All other conditions and requirements of Permit No. M-1987-171 remain in full <br />force and effect. <br /> <br /> <br />Bond Held: $200,000.00 <br />Prior Liability: $200,000.00 <br />Change in Liability: $0.00 <br />Revised Liability: $200,000.00 <br />Prior Permit Acreage: 313.90 <br />Change in Permit Acreage: 0.00 <br />Revised Permit Acreage: 313.90 <br />Prior Affected Acreage: 313.90 <br />Change in Affected Acreage: 0.00
