The Division received CEC Phase I bond release application SL-11 on June 21,2022, and found the <br /> application complete on August 4, 2022, after the Division received proof of publication of the <br /> applicant's public notice. The completeness determination was made in accordance with Section <br /> 3.03.2(1)(d). <br /> Public Notice <br /> CEC published notice of the bond release application in the Fort Lupton Press once weekly for four <br /> consecutive weeks, beginning on June 23,2022. CEC also notified landowners within and adjacent to <br /> the mine permit area, and other interested parties, of the application for bond release, as required by <br /> Section 3.03.2(l). The Division received no written comments, objections, or requests for an informal <br /> conference regarding the bond release application. <br /> Bond Release Inspection <br /> The Division scheduled and conducted a bond release inspection on August 29,2022 in accordance with <br /> Rule 3.03.2(2). Present at the inspection were Ben Moline of CEC,Rob Zuber of the Division, and Dan <br /> MacKinnon and D.J. Cunningham of the Office of Surface Mining Reclamation and Enforcement <br /> (OSMRE). <br /> Despite technical problems associated with GPS equipment used for collecting elevation data during <br /> the inspection, the Division was able to assess the topography of the site. Details of the Division's <br /> observations during the inspection can be found in the inspection report issued by the Division on <br /> August 30, 2022 and the Findings Section of this document. <br /> On October 17,2022,DRMS sent the SL-11 bond release inspection report to CEC and OSMRE. <br /> Adequacy Review <br /> The following issues with the application were identified in the Preliminary Adequacy Review(letter from <br /> the Division dated September 6, 2022): <br /> 1. The following sentence appears on the first page of the application: "Figures 2-5 show the <br /> post-mining contours as compared to the approved topography in the Reclamation Plan in <br /> plan view and cross-section." However,Figures 4 and 5 do not include lines for approved <br /> topography. Please explain this apparent discrepancy, and update the text and/or figures, as <br /> appropriate. <br /> 2. In Figure 3, the Final Cover As Built Surface appears to be inaccurate. This figure suggests <br /> that the topsand piles still exist in Area 38,but they clearly have been removed, per many <br /> inspections by the Division. Please revise Figure 3 to match the current on-the-ground <br /> conditions. <br /> On November 4, 2022,DRMS received a letter from Habitat Management (consultant working for CEC) <br /> with the responses to the adequacy items.
