Simmons <br />Colorado Division of Reclamation, Mining and Safety <br />Office of Mined Land Reclamation <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br /> <br />Re: Adequacy letter for Minor Revision No. MR-471 to Expand the Deer Creek Shaft <br />Fence. <br /> <br /> <br />Dear Mr. Simmons: <br /> <br />Mountain Coal Company, LLC (MCC) submits this response to the Adequacy letter dated <br />November 9, 2022 requesting more information about the fence expansion around Deer Creek <br />shaft. <br /> <br />Below is MCC’s response. <br /> <br />1. The currently approved version of Map 53D (visible at <br />https://dnrweblink.state.co.us/drms/0/doc/927275/Page1.aspx?searchid=08140676-2cae-454b- <br />9b5c-1f6a9ad04abe) contains helpful labels. These have been omitted from the proposed revised <br />version of the map. <br />Please revise Map 53D to restore the labels for the previously approved features, and label the <br />proposed new fence. <br /> <br />Please see attached Revised Map 53D. <br /> <br />2. The Deer Creek facilities are described in Exhibit 77 of the PAP. In order to keep the Exhibit <br />complete and comprehensive, the materials approved with MR-471 will be added to the exhibit. <br />The USFS correspondence already submitted describes some aspects of the fence, but for clarity <br />please specify the following in your response to this letter: <br />a. The length and height of the fence and gate: Total length of fence is 1,260 feet. Height of the <br />new fence is 9 feet tall. <br />b. The materials that will be used: Green chain link fencing material will be used to make up <br />8 feet of the height of the fence. An addition foot of height will be added to the fence using <br />3 strands of barbed wire. SS40 top rails, corner and gate posts and line post will also be <br />used. <br />c. The spacing of the fence posts and the method that will be used to set them: Spacing between <br />SS40 post will be approximately 10 feet and anchored in concrete.
