Townsend <br /> Montrose, CO 81401 <br /> Re: Bond Release Application (SL-08), Oxbow Mining LLC, Elk Creek Mine, <br /> (CDRMS file C-1981-022) <br /> Dear Uncompahgre Field Office: <br /> Oxbow Mining, LLC (OMLLC) is applying for Phase III final liability and reclamation <br /> bond release for portions of the Elk Creek Mine (Colorado Division of Reclamation, <br /> Mining, and Safety permit C-1981-022)in accordance with the approved reclamation plan. <br /> The subject of the bond release is a release from liability and reclamation bond for areas <br /> where it has been demonstrated that OMLLC has completed all reclamation obligations <br /> and successfully met the final revegetation success criteria. <br /> The reclaimed areas requesting bond release are located within the permit area which is <br /> comprised of portions of Sections 27-34, T12S, R90W; Sections 25-27 and 34-36, T12S, R91 <br /> W; Sections 6 and 7, T13S, R89W; Sections 1-12 and 17, T13S, R90W; Sections 1-3 and 11-13, <br /> T3 S,R91 W;all within the 61h PM,Delta and Gunnison Counties,Colorado. The mine permit area <br /> entrance is located north of Somerset, Colorado, and is accessed from Colorado Highway <br /> 133. <br /> As required by Colorado law,whenever bond release is requested, all interested or affected <br /> parties with a valid legal interest must be notified and afforded the opportunity to comment <br /> or request an informal conference on the bond release in accordance with Rule 3.03.3 of <br /> the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />
