Mr. Pat Farr
Ms. Laura Engel
Mr. Jeremy Wilkinson
October 31, 2022
Page 2
contrary to your assertion, when Mr. Harms and Ms. Hill bought their Property, it was not
burdened by any R.S. 2477 roads.
Implied Easements
As you are no doubt aware, there are a number of theories of implied easements in
Colorado property law. Based on my thorough review of the histories of the roads, the pertinent
legal claims, and the geographic orientation of the claims, it is my firm opinion that there are no
legal theories that provide for any access by you over the Harms/Hill Property.
Public Roads
Of course, if Route 287.1 were deemed to be a public road already, you would have a
claim for access over the Property. However, the road does not appear on any County Road Map
and thus is not a County Road. Nor is Route 287.1 a U.S. Forest Service Road that is open to the
public. To the contrary, the USFS has designated the road as not pubic and for Forest Service
administrative use only. This is confirmed by the signs you no doubt have seen on the road as it
traverses the Property, and it will be readily affirmed if you contact the USFS.
Please advise if you have any questions. Thank you.
Since-
nne .
