<br /> <br /> <br /> <br /> <br /> <br />October 28, 2022 <br /> <br /> <br />Scott Davis <br />Schmidt Construction Company <br />2635 Delta Dr. <br />Colorado Springs , CO 80910 <br /> <br /> <br />Re: Fountain Pit - File No. M-1982-155 <br /> Schmidt Construction Company <br /> Technical Revision (TR-3) <br /> Update and Modernize the 36 Year old permit <br /> <br />Dear Scott Davis: <br /> <br />On October 27, 2022 the Division of Reclamation, Mining and Safety concluded its review of the <br />Technical Revision application submitted to the Division on July 1, 2022, addressing the following: <br /> <br />Update and modernize the 36 year old permit to include new aspects not previously known or <br />addressed at the time of permitting. <br /> <br />The decision reached by the Division is: awaiting warranty. <br />This TR also clarified the permit and affected area boundaries to account for previously poorly <br />defined easements. Adjustments were incorporated for permit and affected areas, accordingly. The <br />bond was also re-evaluated based on the revised mining and reclamation plans. The increased surety <br />is reflected below. A detailed cost estimate will be provided via email. <br /> <br />The maximum allowed affected area, for the purpose of bonding is now 298 acres. The AM-3 area is <br />now considered a future phase. As such, the reclamation costs for the AM-3 area have been removed <br />from the new bond estimate. The increased surety is due within 60 days of the date of this letter. <br /> <br />The terms of Technical Revision No. 3 approved by the Division are hereby incorporated into Permit <br />No. M-1982-155. All other conditions and requirements of Permit No. M-1982-155 remain in full <br />force and effect. <br /> <br />The revised liability amount exceeds the financial warranty currently held (see below), please submit <br />additional bond or a rider to your existing bond that equals or exceeds the Revised Liability. The <br />revision will not be final until the bond is approved by the Division. <br /> <br />
