(Tri-State), is the parent company to Axial Basin
Coal Company, which is the general partner to Colowyo Coal Company L.P. (Colowyo). Therefore, Tri-State on
behalf of Colowyo, and in accordance with Rule 5.04.3(1) of the Regulations of the Colorado Mined land
Reclamation Board for Coal Mining is hereby providing additional information within the 15 days as required for
notice of violation CV-2022-001 dated October 4, 2015 and received via certified mail on October 17, 2022.
Overview
On October 2, 2022, a short duration high intensity precipitation event impacted a portion of the Colowyo
Mine's East Pit reclamation including the Final East Pit Ditch,EP 1 and EP2 stock ponds, and the South Collection
Ditch. Eventually, due to the high intensity precipitation event, sediment and rock was transported offsite and
impacted lands outside the mine permit boundary. A full description of the events can be found in the Division's
October 4, 2022 partial inspection report.
Division Notification
Since the precipitation event caused sediment(e.g., rock and miscellaneous natural debris)to flow offsite,
Tri-State immediately recognized the situation and promptly contacted the Division. On October 3, 2022, at
12:52 PM, Mr. Tony Tennyson left a voicemail for Mr. Zach Trujillo. Unbeknownst to Tri-State, the Division
was out of office for a holiday on October 3, 2022. Mr. Tennyson attempted to contact Mr. Trujillo again at 3:51
PM, and then Mr. Jason Musick at 4:34 PM. At that juncture, Mr. Tennyson sent an email to Mr. Trujillo and
Mr. Musick indicating that a conversation needed to occur due to an incident at Colowyo. Mr. Musick called Mr.
Tennyson back at 4:57 PM and both parties discussed the incident that occurred on October 2.
P.O.BOX 33695
DENVER,CO 80233-0695 A Touchstone Energy
303-452-6111 Cooperative
►``
WWW.TRISTATE.COOP
