(Tri-State), is the parent company to Axial Basin <br /> Coal Company, which is the general partner to Colowyo Coal Company L.P. (Colowyo). Therefore, Tri-State on <br /> behalf of Colowyo, and in accordance with Rule 5.04.3(1) of the Regulations of the Colorado Mined land <br /> Reclamation Board for Coal Mining is hereby providing additional information within the 15 days as required for <br /> notice of violation CV-2022-001 dated October 4, 2015 and received via certified mail on October 17, 2022. <br /> Overview <br /> On October 2, 2022, a short duration high intensity precipitation event impacted a portion of the Colowyo <br /> Mine's East Pit reclamation including the Final East Pit Ditch,EP 1 and EP2 stock ponds, and the South Collection <br /> Ditch. Eventually, due to the high intensity precipitation event, sediment and rock was transported offsite and <br /> impacted lands outside the mine permit boundary. A full description of the events can be found in the Division's <br /> October 4, 2022 partial inspection report. <br /> Division Notification <br /> Since the precipitation event caused sediment(e.g., rock and miscellaneous natural debris)to flow offsite, <br /> Tri-State immediately recognized the situation and promptly contacted the Division. On October 3, 2022, at <br /> 12:52 PM, Mr. Tony Tennyson left a voicemail for Mr. Zach Trujillo. Unbeknownst to Tri-State, the Division <br /> was out of office for a holiday on October 3, 2022. Mr. Tennyson attempted to contact Mr. Trujillo again at 3:51 <br /> PM, and then Mr. Jason Musick at 4:34 PM. At that juncture, Mr. Tennyson sent an email to Mr. Trujillo and <br /> Mr. Musick indicating that a conversation needed to occur due to an incident at Colowyo.
