BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE REQUEST BY HOLCIM(US) INC. FOR A <br /> SECOND PERIOD OF TEMPORARY CESSATION, File No. M-2002-096 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") for <br /> consideration on August 17, 2022, in person and via videoconference to consider the <br /> request for a second period of Temporary Cessation filed by Holcim (US)Inc. <br /> ("Operator'), file number M-2002-096 ("permit"). Tim Cazier appeared on behalf of <br /> the Division of Reclamation, Mining and Safety ("Division").1 <br /> The Board, having considered the materials presented with this matter and <br /> having been otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c)reclamation permit for a sandstone, limestone, <br /> and sand and gravel operation. The site is known as the Ranch Land Rock Pit#1 <br /> Pit. The site is located in Fremont County, Township 205, Range 68W, Section 24, <br /> 6ch Principal Meridian. <br /> 2. On September 30, 2021, the Division received Operator's notice for the <br /> first period of Temporary Cessation for the site.The notice stated that Operator had <br /> only conducted exploration drilling on the site and was in the process of amending <br /> the permit for mining operations in the near future to provide limestone to its <br /> Portland Plant. <br /> 3. Operator requested an effective date of July 20, 2017, for this period of <br /> temporary cessation. <br /> 4. The Board approved the request for the first period of Temporary <br /> Cessation at its November 17, 2021 meeting. <br /> 6. On June 3, 2022, the Division received Operator's request for a second <br /> period of Temporary Cessation. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
