<br /> <br /> <br /> <br /> <br />October 18, 2022 <br /> <br />BJ Fogle <br />American Gypsum Company LLC <br />5960 Berkshire Land, Ste 800 <br />Dallas, TX 75225 <br /> <br />Re: Eagle Mine - Upper and East Mining Areas - File No. P-2022-004 <br /> American Gypsum Company LLC <br /> Notice of Intent to Conduct Mineral Exploration <br /> <br />Dear BJ Fogle: <br />The Division of Reclamation, Mining and Safety (Division) has completed its review and has <br />accepted your Notice of Intent to Conduct Mineral Exploration Operations (NOI) submitted for Eagle <br />Mine - Upper and East Mining Areas, File No. P-2022-004. <br /> <br />The Division has also reviewed and approved the financial warranty submitted for the NOI in the <br />amount of $41,580.00. <br /> <br />Pursuant to Rule 5.1.3(c)(iv), the Division’s determination will not take effect until the expiration of <br />the five business days allowed for an appeal, or in the case of an appeal, until the Mined Land <br />Reclamation Board issues its decision. If there are no appeals within the five day appeal period, you <br />may commence exploration operations. <br /> <br />In accordance with Rule 5.8, an Annual Report and associated fee of $86.00 must be submitted on <br />your notice approval anniversary date (October 11) for each year following the filing of an NOI until <br />reclamation responsibility release is granted. In addition, Rule 5.3.4 requires the prospector to notify <br />the Division of completion of exploration operations and Rule 5.6 requires the submittal of a final <br />report for drill holes within 60 days of completion of the abandonment for artesian flow holes and <br />within one year of completion of the abandonment for any other drill holes. <br /> <br />Please note, the acceptance of this NOI shall not be construed to abrogate the duty of the prospector <br />to comply with other applicable laws or regulations, including but not limited to all federal, state, or <br />local permits, licenses, and approvals, as well as any access agreements, as applicable to the specific <br />operation. <br /> <br /> <br />P-2022-004: Approved Surety and Acreage <br />Reclamation Liability (Required Surety): $41,580.00 <br />Approved Permit Acreage: 2.00 <br />Approved Affected Acreage: 2.00 <br />
