NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision Application No. 155 (TR-155) for the Colowyo Coal Mine (Permit No. C-1981-019), submitted by Colowyo Coal Company L.P.. TR-155 proposes two sediment ponds, the Upper and Lower Section 3 Ponds respectively, which are proposed to be within Streeter Ditch directly below the primary crushing facility at Colowyo. The sediment ponds will be used in series with the Lower Section 3 Pond being a non-discharging structure. An The Colowyo Coal Mine is a/an surface coal mine located in Moffat, Rio Blanco County, approximately 28 miles S of Craig, Colorado. Coal interest is federal, state and private, and the surface affected is federal, state and private land. The permit area encompasses approximately 26,133.34 acres. This proposed decision is based on a finding of whether the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the regulations promulgated thereunder.
