adjacent to an established irrigated pasture, and will be easily accessible to farm equipment, and
can be managed along with the established irrigated pasture. Side-roll irrigation structures are
already in place, so any necessary extension of the irrigation structure would be logically
feasible.
The Division sees this proposed relocation of the prime farmland parcel as beneficial due to the
limitations presented with the current mapped location of the prime farmland soils. The current
surface ownership for the existing mapped prime farmland parcel is Elk Ridge Mining and
Reclamation, LLC. The proposed location to reestablish the 4 acres of prime farmland is also
owned by Elk Ridge Mining and Reclamation, LLC.
Water Rights and Usage
The water rights, usage and augmentation plan is presented in Section 2.05.6(3) of the permit
application. There are 11 surface water rights and 29 water wells adjacent to the mine sites.
The monitoring plan is described in Section B, Item II E, of this Findings Document. The plan is
detailed enough to show any impacts on adjacent water rights to the New Horizon Mine. Elk
Ridge Mining and Reclamation, LLC has shown that it has adequate water rights to mitigate any
discovered impacts and this complies with the requirements of 4.05.15.
9
