SCHEDULE TO NOTICE OF VIOLATION <br /> Notice of Violation No.: CV-2022-001 <br /> NATURE OF VIOLATION: <br /> Failure to construct permanent post-mining drainage channels and temporary channels in accordance with the <br /> approved reclamation plan. <br /> ACT,REGULATION,OR PERMIT PROVISION(S)VIOLATED: <br /> ACT SECTION(S): 34-33-120(2)0); 34-33-120(2)0)(II)(A); 34-33-120(2)0)(V) <br /> REGULATIONSECTION(S): 4.01.1(7); 4.05.3(1)(d)and(e); 4.05.3(3),(4)and(7)(a) <br /> PERMIT SECTION(S): Exhibit 7,Item 14,Appendix Exh.7-1413; Exhibit 7,Item 14,Appendix Exh.7- <br /> 14R <br /> PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br /> Failure to minimize disturbance to the hydrologic balance in the mine and associated off-site areas. Failure to <br /> construct a channel so as to not increase the potential for downstream flooding and minimize adverse impacts to <br /> the hydrologic balance. Failure to construct a permanent diversion to safely pass the peak runoff from a 10- <br /> year storm event. Failure to construct a permanent diversion to prevent additional contribution of suspended <br /> solids to stream flow and runoff outside the permit area. <br /> Portion of Operations to Which Applies: <br /> This violation applies to the Final East Pit Ditch and South Collection Ditch. <br /> STEPS NECESSARY TO ABATE VIOLATION(REMEDIAL ACTION): <br /> Abatement Step# Description <br /> 1 Clean sediment transported offsite and repair both the Final East Pit Ditch and South <br /> Collection Ditch to fix erosion problems that have occurred, including the necessary riprap, <br /> to ensure runoff safely flows to the Prospect Pond as currently designed. <br /> 2 Submit to the Division a complete Technical Revision providing a new design for the Final <br /> East Pit Ditch that would safely pass the peak runoff resulting from a 10-year, 24-hour <br /> precipitation event which would not contribute to adverse impacts to the hydrologic balance <br /> in the mine and associated offsite areas. <br /> TIME FOR ABATEMENT(NOT MORE THAN 90 DAYS): <br /> ON OR BEFORE last abatement due date <br /> Abatement Step# Due Date <br /> 1 January 10,2023 <br /> 2 January 10,2023 <br /> Page 3 of 3 <br />
