NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Permit Revision Application No. 9, submitted by Elk Ridge Mining and Reclamation, LLC for a coal mining permit at the New Horizon Mine (Permit No. C-1981-008). PR-09 proposes to relocate 4 acres of Prime Farmland reclamation to a location with greater accessibility to agricultural management The New Horizon Mine is a/an surface operation located in Montrose County, approximately 1.7 miles Northwest of Nucla, Colorado. Coal interest is private, and the surface to be affected is private land. The permit area encompasses approximately 345.85 acres. This proposed decision is based on a finding of whether the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the regulations promulgated thereunder. Copies of the proposed decision, including any stipulations, are on file for public inspection at the Montrose County Courthouse, 300 Main Street, Nucla, CO 81424.
