<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 15 (SL-15) for the West Elk Mine, Permit No. C-1980-007. With <br />the approval of SL-15 Mountain Coal Company is released from phase I reclamation liability for <br />11.67 acres of disturbance, including the plugging and abandonment of 10 Mine Ventilation <br />Boreholes; and the backfilling and grading of associated roads and pads. The underground <br />operation is operated by Mountain Coal Company, LLC under the provisions of the Colorado <br />Surface Coal Mining Reclamation Act of 1979. The bond release application was submitted by <br />Mountain Coal Company, LLC on January 26, 2022. Surety Release No. 15 seeks Phase I Bond <br />Release for the plugging and abandonment of 9 Mine Ventilation Boreholes (MVBs) and the <br />backfilling and regrading of associated pads and roads in the Dry Fork of Minnesota Creek area, <br />comprising a total of approximately 7.65 acres.
