Division released$2,221,087.89 with the approval of SL-2 approved on July 3,2019 for phase I backfill <br /> and grading of 120.2 acres of Irrigated and dryland pasture. <br /> The Division holds a performance bond of$950,000.00 for the New Horizon North Mine. The current <br /> liability for the site is $908,768.00. The Division conducted a reclamation cost estimate for the <br /> remaining reclamation tasks required to be conducted after SL-03 to assure completion of the remaining <br /> reclamation work at the site if the work had to be performed by the Division, including the cost of <br /> reestablishing vegetation on any revegetated areas, should those areas fail. The Division estimates its <br /> cost to complete remaining reclamation work at the site to be $450,979.00. The Division proposes to <br /> release $474,845 for costs associated with the requested bond release areas. <br /> Two different methods were used to determine the releasable bond amount. The first method <br /> removed the tasks associated with SL-3 that have been completed from the updated reclamation cost <br /> estimate. <br /> The second method used the percentage Rule 3.03.1(2)(a)which states that the Division can release <br /> up to 25% of the applicable bond amount for Phase 11 bond release. The 118.7 acres that are <br /> requested for Phase 11 bond release in SL-2 make up 75.6% of the 157.1 total disturbed acres as <br /> reported in the 2021 ARR. <br /> The current liability (prior to SL-3) for the site is $908,768.00. Twenty-five percent (25%) of the <br /> applicable reclamation costs for Phase 11 is $782,463.98 based upon the overall site wide liability <br /> prior to previous bond releases, but adjusted for mine plan adjustments (RN-02 RCE). The <br /> percentage of disturbed area being Phase 11 released is 75.6%. 76.5% of 782,463.98 is $591,532.76. <br /> The Division would be unable to release more than this amount for the Phase 11 bond release for the <br /> 118.7 acres requested in SL3. <br /> The percentage of disturbed area being requested for Phase III released is 2.4% Two point four <br /> percent (2.4%) of 469,478.30 is $11,267.00. <br /> Any person with a valid legal interest which might be adversely affected by this proposed decision <br /> may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br /> Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the San Miguel <br /> Basin Forum as soon as possible. Requests for public hearing must be submitted to the Division in <br /> writing within thirty days of the day following the first publication in the San Miguel Basin Forum. <br /> If no hearing is requested within those thirty days, the Division's decision will become final. <br /> Permit Number C2010-089 <br /> Page 9 of 10 <br />
