L PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br /> Elk Ridge Mining and Reclamation, LLC applied for partial bond release under the Colorado <br /> Surface Coal Mining and Reclamation Act following reclamation of the New Horizon North <br /> Mine. The mine is located in Montrose County, Portions of Sections 25 and 36, T 47 N, R 16 <br /> W,N.M.P.M. The mine area is located in: <br /> Township 47 North, Range 16 West, New Mexico Principal Meridian <br /> Section 25: W 1/2 <br /> Section 36: Portions of the NW 1/4 and the NW 1/4 NW 1/4 SW 1/4 <br /> Two previous bond releases have been approved for the New Horizon North Mine. <br /> Bond Release No. 1, SL-1,was approved December 17,2018. SL-1 approved ERMR's request <br /> for a partial Phase I, II and III bond release for the New Horizon North Mine. Sl-1 released the <br /> applicant from liability for the sealing of the 3 monitoring wells (GW-47, GW-48 and GW-49) <br /> on the Glasier property. No change or reduction of disturbed acres were requested nor were <br /> any approved. SL-1 approved release of$4,049.55 of the reclamation liability bond. <br /> Bond Release No. 2, SL-2, was approved on July 3, 2019. The Division approved ERMR's <br /> request for a partial Phase I bond release for the New Horizon North Mine. SL2 released the <br /> applicant from liability for backfilling, grading, and drainage reestablishment for 120.2 acres <br /> identified on Map 1 of the SL-2 application. The Division released $2,221,087.89 with the <br /> approval of SL-2. <br /> An application for a partial Phase II and III bond release was received by the Division on <br /> January 20, 2022. The application was deemed complete on February 17, 2022, after the <br /> Division received proof of publication of the applicant's public notice. Elk Ridge Mining and <br /> Reclamation, LLC published notice of the bond release application in San Miguel Basin Forum <br /> once weekly for four consecutive weeks, beginning January 27, 2022. Elk Ridge Mining and <br /> Reclamation, LLC also notified land owners within and adjacent to the mine permit area, and <br /> other interested parties of the application for bond release, as required by Rule 3.03.2(1). <br /> No comments, written objections, or requests for an informal conference regarding the bond <br /> release application were received by the Division. <br /> The Division scheduled and conducted a bond release inspection on February 23, 2022. The <br /> site inspection was conducted in accordance with Rule 3.03.2(2). The inspection was <br /> accompanied by Tony Tennyson of Elk Ridge Mining and Reclamation, and Mr. Dustin <br /> Garvey, landowner of a large portion of the requested bond release area. Mr. Stan Garvey, <br /> landowner, also met us at the mine office, but did not accompany the inspection into the field. <br /> The areas requested for bond release are owned by the Garvey's or Elk Ridge Mining and <br /> Reclamation, LLC. <br /> Due to fresh snow on the morning of February 23,2022, a portion of the requested bond release <br /> Permit Number C2010-089 <br /> Page 3 of 10 <br />
