The property <br />is located on the east side of Weld County Road 23, in Sections 35 and 36 of Township 6 North, Range 67 West <br />of the 6th Principal Meridian. <br />Martin Marietta is applying to the Colorado Division of Reclamation, Mining and Safety (DRMS) for a 112 <br />Reclamation Permit. We have identified one or more structures that we believe you own within 200 feet of the <br />affected area associated with this Permit. As part of their application and planning, Martin Marietta has taken <br />steps to prevent any impact to your structure(s). <br />Consistent with DRMS Construction Materials Rule 6, Section 6.4.20, Martin Marietta, as the permit applicant, <br />shall identify permanent man-made structures within 200 feet of the affected area of the proposed mine site and <br />request a notarized agreement with each structure owner, indicating that Martin Marietta will compensate the <br />structure owner for any damage to the structure(s) caused by Martin Marietta. <br />Attached to this letter you will find the Structure Agreement. The Agreement assures you that Martin Marietta will <br />take responsibility for damage to your structure(s) if Martin Marietta’s mining or reclamation activities <br />unexpectedly affect your structure(s). The DRMS provided the language used in the Structure Agreement. Also <br />attached to this letter is a draft copy of the Pre-Mining and Mining Plan maps associated with the Windsor East <br />Mine application to help you understand the location of your structures in relation to the permit boundary and <br />Martin Marietta’s planned mining cells. <br />Please sign and notarize the Agreement and return the Agreement in the enclosed, stamped and addressed <br />envelope as soon as possible, preferably no later than Monday, October 10, 2022.
