COLORADO <br /> Division of Reclamation, <br /> C&O Mining and safety <br /> Department of Natural Resources <br /> September 13, 2022 <br /> Mary Vasquez <br /> Perdue Site <br /> 750 Crisman Dr., Apt A201 <br /> Longmont, CO 80501 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing <br /> Perdue Site; Permit No. M-2000-089 <br /> Mary Vasquez: <br /> On July 8, 2022, the Division of Reclamation, Mining and Safety (Division/DRMS) sent you, Mary <br /> Vasquez, and Orlando Vasquez a notice of financial warranty increase (Revision No. SI-1). The required <br /> financial warranty for the Perdue site was increased to $15,772.00, which is an increase of $3,272.00 <br /> from the currently held financial warranty of $12,500.00. The additional required financial warranty <br /> was due on September 6, 2022. <br /> The Division believes this is a violation of: <br /> • C.R.S. 34-32.5-117(4)(c)(I1) and Rule 4.2.1(2) for failure to post the additional required financial <br /> warranty within sixty (60) days of the date of notice of the adjustment. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation <br /> Act for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sea., and the provisions of your <br /> Permit No. M-2000-089, and has scheduled this matter to appear before the Board. <br /> A Formal Public Hearing will be held during the October 19-20, 2022 Mined Land Reclamation Board <br /> Hearing. This Board hearing will be held by a virtual Zoom hearing. In order to receive an authorization <br /> code to attend the hearing, please contact Camille Mojar via telephone at 303-866-3567, ext. 8136 or <br /> via email at Carnill ar state.mus. Please note that only Parties and thos-e-who will be testifying <br /> may attend the Board hearing by ZOOM. All other interested persons may view the hearing via the <br /> Board's YouTube Channel at: httas:/lw w.vgutube_qom1rhannel/UCDrrA08bIPF1Qwce-yH1fWA. <br /> If the Board finds a violation at this hearing, it may issue a cease-and-desist order pursuant to C.R.S. <br /> 34-32.5-124(2); suspend, modify, or revoke the permit pursuant to C.R.S. 34-32.5-124(6)(a); assess a <br /> civil penalty in the amount of $100.00 to $1,000.00 for each day of violation pursuant to C.R.S. <br /> 34-32.5-124(7); and/or find the financial warranty subject to forfeiture pursuant to C.R.S. <br /> 34-32.5-118(1).
